Legal Counsel Isn’t Guaranteed in Tribal Court — But Help Is Still Available

Tribal courts are not required to provide legal counsel under the U.S. Constitution because tribes are sovereign nations. In Talton v. Mayes, 163 U.S. 376 (1896), the Supreme Court ruled that constitutional protections, such as the right to appointed counsel, do not apply to tribal governments in the same way they apply to federal or state governments. This principle was later upheld by the Indian Civil Rights Act of 1968 (25 U.S.C. § 1302), which mirrors some constitutional rights but does not require tribes to appoint legal counsel in civil cases.

As a result, many people must represent themselves in tribal court — even in serious matters like housing, custody, or safety. Our legal aid team is here to help. We offer free or low-cost support to guide you through the process, protect your rights, and ensure your voice is heard.
